Stakeholder Input on Minor Works Order – Transport Canada

In February 2018, the Government of Canada introduced proposed legislation (Bill C-69) which would enact the Impact Assessment Act and the Canadian Energy Regulator Act, amend the Navigation Protection Act, and make consequential amendments to other Acts. The changes created a new Canadian Navigable Waters Act (CNMA).

Now that the CNWA is in place, Transport Canada is engaging stakeholders to review the Minor Works Order. The Order names the types of “minor” works that are unlikely to interfere with navigation. Minor works do not require approval if the work meets the criteria and requirements found in the Order.

Transports Canada wants to hear from impacted stakeholders on:

  • The types of works to include in the Minor Works Order;
  • Your suggested changes to the existing classes of minor works; and
  • Proposed terms and conditions for the construction of these works.
